COURT DATES AND LOCATION

Post all court dates here.  Also post which courts the appearance is, i.e. Middlesex, Concord, Worcester, etc.....
I encourage people to show up, even if you are not involved in that particular case.

    We have a depositino of John Ruggeiri on Thursday of this coming week. We tried to do it yesterday (Friday) but his attorney said he "was not available" Couldn't get any alternative dates from his attorney and finally his attorney tried to get a protective order. In that hearing, we finally got a new deposition date of Thursday of this coming week. John Ruggeiri is the attorney who took title to several Paul McMann proprties in trust and then financed them with large mortgages.

I have been waiting so long for just this appeal to get heard. Cannot wait to get my trial date. Can we have a party after this devil finally gets what he deserves? The man is so brilliant, I don't understand why he didn't use his brains in a respectable way, he would have been so successful.

    I have a question for Margaret regarding her posting on the other blog, regarding the fact that PM did not spend any time in jail for a criminal offense.

    I did not think that we had "debtors prisons" in the US. Even OJ Simpson has walked for 10 years on an extremely high judgement, and high profile.

    I am curious as to why PM would have been sentenced to any jail time in failure to pay on his judgements? Is that (and I ask out of ignorance, not knowledge) because he had money to pay, but chose not too? Does a guy like OJ roam free because he has no money, at least in the form of "provable money"? I am confused. And it is not your job to answer that, but I guess the law can be confusing and for those of us trying to do the right thing I personally need some sort of clarification, if you can.

    From what I heard, PM has another Court Case involving 10's of thousands of dollars. The date is 11/9/07 at the Cambridge Court house. Please correct me if I am wrong? I urge all that have cases against PM to show up. Personally it feels good to see PM & David squirm and there is power in numbers. I assure you with what I saw today, there is nothing to fear about PM anymore. He is being hit every which way and he is on his way out. I wonder if PM should hire a better Lawyer?
    To the person called Paulsux - today seeing PM lose a case was a much better feeling than any fight that I ever fought. Having his Lawyer complain about me being there was sweet. On the same token, I would never back down from him. He sued me after bouncing checks to me and I will not back down here until it is over. I just wanted to be done with him and he came after me. I have a very qualified Lawyer and I have no fear at all. On that note, we hope to have attachments on the Dorchester property this week.

However, after the court has made an order (like an order to pay) and there is no compliance with the order - and there is no excuse or justification - the court can hold the person in contempt for refusal to comply with the order. In this case, Paul McMann (according to the docket of the case) defaulted in the original case and a determination was made that he owed the amount claimed. The order in the small claims judgment usually contains a separate order to pay in 30 days. Then there is a compliance hearing to see whether the judgment has been paid. According to the docket, Paul McMann again defaulted. A capias issued to secure his attendance at court. He was (accoridng to the docket) brought in under the capias. I understand that there was a hearing to determine whether there was any excuse for his non-payment. The judge was aware that he had purchased a house in Weston for over a million dollars. Based on all that the judge heard, the judge found him in contempt of the order to pay the judgment in full. The sentence was for the contempt. I understand - and the docket shows this - that he was taken to the Cambridge Jail, which is the top few floors of the Middlesex Superior Court House in Cambridge. He spent the night and the next day was brought over to the Somerville Court. When we had the deposition of his attorney, John Ruggieri, the attorney stated that Paul McMann had called him from the jail (actually he said from the Middlesex Superior Court, but we know it was the jail on top of the Middlesex Superior Court House), askesd him to bring enough money to pay the judgment. The attorney did - he said it was his own money that he was lending to PM - and the judge let Paul McMann go. Because he had purged himself of the contempt of court in failing or refusing to pay the judgment. A long time ago, we did have debtor's prison, but it has been outlawed for a long time now. But we still do have contempt of court. It is unusual, but it does happen.

(I believe this case relates to a sale of a condominium in Somerville where there were serious construction flaws, including the construction of the foundation.     In the case of First Commonwealth Ventures v. Arthur Desrosiers, the Court had entered a restraining order againsts Paul McMann taking any of the rent money from the properties conveyed to John Ruggieri. A few months later, PM filed a motion to let him use the rent money to pay mortgages etc. He said at that time (August or September) that the mortgages were 90 days past due. The court entered an order permitting him to pay real estate expenses only if he gave me notice wihtin 24 hours. He could only pay past due expenses, not in advance. I have never gotten any notice that he paid anything and I have asked his attorney many times about any payments. Finally, I requested reconsideration of the order. Got this in the mail today regarding the motion for reconsideration:
    MOTION (P#27.0) Court will reconsider on 1/15/08 at 2:00 p.m. and
    2 will also consider sanctions including legal fees, costs and
    3 limitation on evidence (John P. Connor, Jr. Associate Justice). dated
    4 12/27/07. Notices mailed 12/28/2007
